Terms of Service
Last updated: April 2026
1. Overview
[PLACEHOLDER — FOR LAWYER REVIEW] These Terms of Service ("Terms") govern your use of services provided by Pixelpond Studio ("we", "us", "our"), an Australian-based web development service. By engaging our services, you agree to be bound by these Terms.
2. Services
[PLACEHOLDER — FOR LAWYER REVIEW] Pixelpond Studio provides custom website and web application development services. The specific scope of work for each project is defined in a separate project quote or scope of work document, which forms part of these Terms.
3. Quotes and Pricing
[PLACEHOLDER — FOR LAWYER REVIEW] All quotes are provided in Australian Dollars (AUD) and are valid for 14 days from the date of issue unless otherwise stated. Quotes are fixed-price and cover the scope of work outlined in the project agreement. Additional work outside the agreed scope will be quoted separately.
4. Payments
[PLACEHOLDER — FOR LAWYER REVIEW] Payment is structured as follows:
- 50% deposit payable upon acceptance of the quote
- Remaining 50% payable upon completion and before final handover
All payments are processed securely via Stripe. Late payments may incur additional charges and may delay project delivery.
5. Intellectual Property
[PLACEHOLDER — FOR LAWYER REVIEW] Upon receipt of full payment, all intellectual property rights in the deliverables are transferred to you, the client. This includes source code, designs, and assets created specifically for your project. Third-party libraries, frameworks, and open-source components remain subject to their respective licences.
6. Revisions
[PLACEHOLDER — FOR LAWYER REVIEW] Each project includes one round of revisions as outlined in the project agreement. Additional revisions beyond the included round may be quoted separately.
7. Project Timeline
[PLACEHOLDER — FOR LAWYER REVIEW] Estimated timelines are provided in good faith but are not guaranteed. Delays caused by late feedback, scope changes, or circumstances beyond our control may extend the timeline. We will communicate any significant delays promptly.
8. Cancellation and Refunds
[PLACEHOLDER — FOR LAWYER REVIEW] If you wish to cancel a project after paying the deposit:
- If work has not commenced, the deposit may be refunded less an administrative fee
- If work has commenced, the deposit is non-refundable but any work completed will be delivered to you
We reserve the right to cancel a project and refund the deposit if we determine the project is not a suitable fit.
9. Liability
[PLACEHOLDER — FOR LAWYER REVIEW] To the maximum extent permitted by Australian law, our liability is limited to the total amount paid for the project. We are not liable for indirect, consequential, or incidental damages arising from the use of the deliverables.
10. Confidentiality
[PLACEHOLDER — FOR LAWYER REVIEW] Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the completion or termination of the project.
11. Governing Law
[PLACEHOLDER — FOR LAWYER REVIEW] These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be resolved in the courts of Australia.
12. Changes to These Terms
[PLACEHOLDER — FOR LAWYER REVIEW] We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
